1. Acceptance of Terms
By accessing, browsing, or using the ThinkDeck platform, you affirm that you are at least 13 years of age (or the age of legal majority in your jurisdiction, if greater than 13), and that you have read, understood, and agree to comply with these Terms. These Terms constitute a legally binding agreement between you and ThinkDeck.

You may be required to register and create an account to access certain features of the Platform.
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You agree to notify ThinkDeck immediately of any unauthorized use of your account.
ThinkDeck is not liable for any loss or damage arising from your failure to protect your account credentials.

ThinkDeck grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Services for your personal, non-commercial educational purposes, strictly in accordance with these Terms.
You agree to use the Platform and Services in compliance with all applicable local, state, national, and international laws and regulations.
5. Assessments and AI Content
The Platform provides access to learning content, including assessments (quizzes) and summaries, which may be manually created or generated using artificial intelligence based on various sources, including potentially content you provide.
AI-Generated Content
AI-generated content, including questions and summaries, is provided for educational and self-assessment purposes only. While efforts are made to ensure quality and relevance through validation processes (which may involve machine learning or human review), ThinkDeck does not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose.
Academic Integrity
You agree to use the Platform's tools, including AI-generated content, for honest self-assessment, practice, and learning. You must NOT use the Platform or any generated content in a manner that violates academic integrity policies of any educational institution, including but not limited to using it for cheating on external evaluations, plagiarizing content, or misrepresenting AI-generated work as your own original thought.
6. Data Privacy
Your use of the Platform is subject to our Data Privacy Policy, which explains how we collect, use, and protect your personal data, including information about your learning behaviour and results. By using the Platform, you consent to the data practices described in our Privacy Policy.
While we implement security measures to protect your data as outlined in our Privacy Policy, no system is completely secure. You acknowledge that absolute security cannot be guaranteed.
7. Intellectual Property
All Content on the Platform, including but not limited to the design, text, graphics, images, quizzes, summaries, underlying software, AI models, logos, and trademarks, are the exclusive property of ThinkDeck or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited license to access and view the Content solely for your personal, non-commercial educational use as permitted by these Terms.
You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content on our Platform, except as incidentally necessary to access the Platform for its intended purpose, without the prior written consent of ThinkDeck.
8. Prohibited Conduct
You agree NOT to:
Use the Platform for any illegal, fraudulent, or unauthorized purpose.
Engage in any activity that is disruptive, damaging, or harmful to the Platform or its users.
Attempt to gain unauthorized access to any part of the Platform, user accounts, or computer systems or networks connected to the Platform.
Circumvent, disable, or otherwise interfere with security-related features of the Platform.
Reverse engineer, decompile, or attempt to extract the source code of the Platform or its underlying software, including any AI models.
Use the Platform to generate or disseminate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Use any automated system, including bots, spiders, or scrapers, to access or scrape the Platform without our express written permission.
Violate the academic integrity policies mentioned in Section 5.
9. Content Validation
Content generated through the Platform (e.g., quizzes, summaries) that you do not explicitly save or retain may be subject to internal quality review processes.
This review may include automated machine learning algorithms or human validation to assess relevance, accuracy, quality, and uniqueness before such generated content is potentially used to improve the Platform, train models, or is stored for future use by ThinkDeck (excluding any direct association with your identity).
10. Termination
ThinkDeck reserves the right to suspend or terminate your access to the Platform, or any part thereof, at any time, for any reason, including without limitation, if you violate these Terms, misuse the Platform, or engage in conduct that ThinkDeck deems harmful to the Platform or its community.
Upon termination, your right to use the Platform will immediately cease.
11. Disclaimers and Limitation of Liability

THE PLATFORM AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THINKDECK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

You rely on such information strictly at your own risk. The Platform is not a substitute for formal education, professional advice, or official assessment.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THINKDECK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (D) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT THINKDECK HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
12. Amendments
ThinkDeck reserves the right to modify or revise these Terms at any time in its sole discretion. Any changes will be effective immediately upon posting the revised Terms on the Platform. Your continued use of the Platform after the posting of changes constitutes your binding acceptance of such changes. We encourage you to review these Terms periodically.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in India.
